General terms and conditions - Workshops
Candice Bakes is a sole proprietorship (EI), registered with the Registre du commerce et des sociétés (R.C.S.) d'Epinal, as well as with the Chambre des métiers de l'artisanat (CMA) Grand Est under SIRET number 81391496700035 (SIREN number 813 914 967), whose head office is located at 54 Rue des Anémones 88100 SAINTE MARGUERITE. In the remainder of this document, it will be referred to by the generic term Candice Bakes.
The Candice Bakes website is accessible at the following address: www.candicebakes.com.
The workshop and cake reservation service, the physical and/or distance selling of Candice Bakes' services and products, offered by Candice Bakes, is intended exclusively for consumers for the satisfaction of their personal needs, to the exclusion of any purchase for resale.
In the remainder of this document, the consumer will be referred to as the Customer.

ARTICLE 1 - Acceptance of the general terms and conditions of sale (GTCS)
These GTC are brought to the attention of the Customer to enable him to place an order.
By confirming an order, the Customer fully accepts these GTC, which alone shall apply to the subsequent contract. By placing an order, the Customer accepts the GTS without reservation.
ARTICLE 2 - General
Any purchase of one or more workshops or gift voucher(s) implies your acceptance of these conditions. Therefore, no contrary, additional or modifying clause can be opposed to Candice Bakes unless Candice Bakes has expressly accepted it. These terms and conditions apply to the workshops offered by Candice Bakes. The online registration form constitutes the contract between the Customer and Candice Bakes.
ARTICLE 3 - Workshop content and schedule
Candice Bakes offers patisserie workshops, courses and events for individuals and professionals, the various themes of which are presented on the website. www.candicebakes.com and detailed in the personalized quotes. These workshops take place at Candice Bakes' studio or in locations with which Candice Bakes has made prior arrangements. Each workshop offered on the Candice Bakes website (www.candicebakes.com) is presented with its name, composition, price, dates and times. In addition, the recipes developed during the courses are not contractual but given as an indication and vary according to the market and the season. The recipes are the property of Candice Bakes.
The Customer agrees not to film and/or take photographs during the workshops, unless specifically authorized by Candice Bakes and the other participants.
ARTICLE 4 - Workshops for minors
Candice Bakes offers pastry workshops for minors: the Children's workshop, for children aged 8 and over. Children must be accompanied by an adult at the start of the workshop. The same adult will collect the child. If someone other than this adult is picking up the child, Candice Bakes must be informed at the start of the workshop.
The minor's parents or legal guardians certify that, on the day of the workshop, they are covered by civil liability insurance.
The workshop will take place under the supervision of Candice Basso, who will refer any problems to the adult in charge.
ARTICLE 5 - Order process
5a) Workshops available on the course calendar, under Workshops on www.candicebakes.com
- Customers can consult the list of workshops in the Pastry classes of the www.candicebakes.com.
- To reserve a place, the Customer clicks on the Book of the corresponding workshop, and proceed to the online payment in order to validate the reservation. To be registered, the order must be paid in full. Payment by the Customer implies validation of the order and acceptance of these GCS. Candice Bakes does not offer discounts.
- The customer receives an email confirming payment and booking the selected workshop.
- On the day of the workshop, the Customer must arrive on time for the workshop.
5b) Animations, Team Building and workshops for groups
- To make a reservation, the customer must fill in the contact form accurately and thoroughly.
- Candice Bakes may call to clarify certain points. The customer receives a personalized quote as soon as possible.
- In order to validate the quotation, the Customer must reply to contact@candicebakes.com by return email, stating acceptance of the quotation and paying 50% of the total price as a deposit, or the full price if the Customer so wishes, in order to validate the booking. Candice Bakes does not offer discounts.
ARTICLE 6 - Acceptance
The sale is not completed until full payment has been received.
Candice Bakes does not offer discounts.
Candice Bakes reserves the right to refuse an order if it is abnormal or comes from a customer with a history of payment incidents.
ARTICLE 7 - Gift voucher
Gift vouchers are only valid when booking one or more workshops at Candice Bakes.
Gift Certificates are valid for one year from their date of issue, which corresponds to the date of order. Reservation and participation in a workshop must be made within the period of validity of the Gift Certificate.
Gift Certificates are issued in electronic format with a unique reservation code. Upon receipt of payment by Candice Bakes, the Gift Certificate is sent electronically to the e-mail address indicated by the Customer at the time of ordering.
Gift voucher holders contact Candice Bakes to reserve their place.
Gift vouchers are non-refundable.
ARTICLE 8 - Postponement and cancellation by Candice Bakes
Candice Bakes reserves the right to cancel or modify the composition and/or dates and times of the workshops, depending on the number of participants, product supply contingencies and/or the precautionary principle.
A minimum of 3 participants is required to run the workshop.
ARTICLE 9 - Deferral by participant
No postponements, cancellations or requests for refunds will be accepted once your workshop has been booked and paid for, except in certain circumstances detailed below.
If the customer fails to attend the workshop, the workshop will not be reimbursed.
9a) Postponement of workshop by participant
In the event that the Customer is unable to attend the workshop booked, he/she may request that his/her participation be postponed to another workshop offered on the site. www.candicebakes.com subject to availability.
The postponement can only be made once and under the condition that the Customer has notified Candice Bakes by e-mail at the following address: contact@candicebakes.com at least 15 days before the workshop date. If the customer gives notice between 14 days and 48 hours before the workshop date, a processing fee of €20 (incl. VAT) will be applied.
In the case of private workshops with payment of a deposit, if the Customer gives notice between 14 days and 48 hours before the date of the workshop, the deposit paid will not be refunded to cover costs already incurred by Candice Bakes. If postponement is requested less than 48 hours before the workshop or on the day of the workshop, no refund will be made.
In order to benefit from an exceptional postponement free of charge, a medical certificate is required to justify the impossibility of taking part in the workshop.
Failure to comply with these formalities will result in Candice Bakes being unable to accept a postponement of the workshop.
9b) Extending the validity of a gift voucher or reservation
In the case of a postponement within the framework of a gift voucher, the second registration must be made during the voucher's validity date. The validity date remains unchanged.
No extension of the validity period of the gift voucher or reservation is possible unless the beneficiary can prove, by means of a medical certificate, that he/she is totally unable to take part in a workshop before the end of the validity period of the gift voucher or reservation. In this case, the validity of the gift voucher or reservation will be extended to the end of the current calendar year. No further postponements will be accepted.
ARTICLE 10 - Rates
The prices in force are those shown on the website at the time of purchase. Prices are in euros and include VAT. The prices displayed on the Candice Bakes website may be revised according to the price of seasonal products and economic conditions.
ARTICLE 11 - Terms of payment
If the workshop participant chooses to pay online, payment will be made by credit card via the payment form.
If the workshop participant chooses not to pay online, the Customer must contact Candice Bakes to inform them and the total amount of the workshop price must be received by Candice Bakes by post within 5 days of the reservation date, as evidenced by the postmark. If this period is exceeded, Candice Bakes reserves the right to dispose of the initial reservation.

For bank transfers, the necessary information (RIB) will be communicated to the Customer at the time of the order.
ARTICLE 12 - Right of withdrawal
In accordance with article L.221-28 of the French Consumer Code, "the right of withdrawal cannot be exercised for contracts [...]:
- The provision of accommodation services, other than residential accommodation, goods transport services, car rental, catering or leisure activities that must be provided on a specific date or at a specific time;".
- For Gift Certificates, in accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen days from receipt of the Gift Certificate to exercise his/her right of withdrawal from the Service Provider, without having to justify his/her reasons or pay any penalty, for the purpose of exchange or reimbursement, within 14 days of notification to Candice Bakes of the Customer's decision to withdraw.
The right of withdrawal may be exercised online at the following email address: contact@candicebakes.com together with details of the order, in which case a reply will be made to the Customer within one working day by Candice Bakes, or any other unambiguous statement expressing the wish to withdraw.
The refund will be made within 14 days of receipt by Candice Bakes of the Gift Certificate(s) returned by the Customer in accordance with the conditions set out in this article.
The bearer of the gift voucher may under no circumstances request a refund, as he or she is not the customer who made the purchase.
ARTICLE 13 - Liability
Candice Bakes has third-party liability insurance. Nevertheless, the customer is obliged to have his/her own insurance in the event of an accident.
Candice Bakes reserves the right to cancel a workshop in the event of force majeure, and shall not be held liable for such cancellation.
In the event of product changes, the Customer accepts that Candice Bakes may make some adjustments or changes to a recipe initially proposed for a given workshop depending on product availability.
Workshops require the active participation of the Customer. The latter agrees to be vigilant and to abide by the health and safety instructions given by Candice Bakes, in order for the workshop to run smoothly.
Candice Bakes cannot be held responsible for any damage caused to the Customer's person or property during the baking exercises.
Candice Bakes cannot be held responsible for any damage or loss of objects and personal effects brought by the Customer. At the end of the workshop, the Customer who wishes to reproduce a recipe proposed by Candice Bakes will do so under his/her sole, unique and entire responsibility. It is the Customer's responsibility to ensure that no risk arises from the preparation of the recipe or the consumption of products acquired by the Customer. Candice Bakes cannot be held responsible for the result of a recipe prepared by the Customer, on the grounds that it was previously proposed during a Course.
Candice Bakes cannot be held responsible for any damage resulting from the consumption of dishes prepared on Candice's premises and consumed off the premises.
It is forbidden to sell any product made during a workshop at Candice Bakes.
ARTICLE 14 - Warranties
Candice Bakes guarantees, in accordance with legal provisions and without additional payment, the Customer against any lack of conformity or latent defect resulting from a design or manufacturing defect in the Services ordered under the conditions and according to the procedures defined in these General Terms and Conditions of Sale.
Candice Bakes' guarantee is limited to the reimbursement of workshops actually paid for by the Customer, and Candice Bakes may not be considered responsible or in default for any delay or non-performance resulting from the occurrence of a case of force majeure as usually recognized by French jurisprudence.
ARTICLE 15 - Allergies
The customer undertakes to mention any allergies precisely so that none of the allergens mentioned by the customer are used in the order.
The workshops use products that may contain traces of the main allergens. Candice Basso/Candice Bakes cannot be held responsible for the ingestion of allergenic products by people who have consumed the products produced in the workshop. Apart from the presence of allergens in the recipe, it is impossible to exclude the accidental presence of other allergens which may have appeared either during the manufacture of the products by our suppliers, or during transport.
ARTICLE 16 - Data protection
Pursuant to Law 78-17 of January 6, 1978, amended by Law no. 2018-493 of June 20, 2018, it is reminded that the personal data requested from the Customer is necessary for the processing of his/her order and the preparation of invoices, in particular.
This data may be communicated to any of the Service Provider's partners responsible for executing, processing, managing and paying for orders.
The processing of information communicated via the www.atelier-de-yann.com website complies with legal requirements for the protection of personal data, and the information system used ensures optimum protection of such data.
In accordance with current national and European regulations, the customer has a permanent right of access, modification, rectification, opposition, portability and limitation of the processing of information concerning him or her.
This right may be exercised in accordance with the terms and conditions set out on the www.candicebakes.com website.
ARTICLE 17 - Intellectual property
Website content www.candicebakes.com is the property of the Service Provider and its partners and is protected by French and international intellectual property laws.
Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.
In addition, the Service Provider remains the owner of all intellectual property rights to the forms, recipes, photographs, presentations, studies, drawings, models, prototypes, etc., produced (even at the Customer's request) with a view to providing the Services to the Customer. The Customer is therefore prohibited from reproducing, exploiting, copying, imitating for commercial use and competition said forms, recipes, studies, drawings, models and prototypes, etc., without the express, written and prior authorization of the Service Provider, which may be conditional upon financial consideration.
ARTICLE 18 - Force majeure
The Parties shall not be held liable if the non-performance or delay in performance of any of their obligations as described herein is due to force majeure, as defined in article 1218 of the French Civil Code.
The Party observing the event must immediately inform the other Party of its inability to perform its service and justify this to the latter. The suspension of obligations shall under no circumstances give rise to liability for non-performance of the obligation in question, nor lead to the payment of damages or late penalties.
Performance of the obligation is suspended for the duration of the force majeure if it is temporary. Consequently, as soon as the cause of the suspension of their mutual obligations disappears, the Parties will make every effort to resume normal performance of their contractual obligations as soon as possible. To this end, the Party prevented will notify the other of the resumption of its obligation by e-mail giving rise to an acknowledgement of receipt by the addressee, and failing this by registered letter with acknowledgement of receipt or any extrajudicial act). If the impediment is definitive, the present contract will be purely and simply cancelled.
During this suspension, the Parties agree that the costs incurred by the situation will be borne by the party prevented from doing so.
ARTICLE 19 - Applicable law - Disputes
The present Terms and Conditions and all operations referred to herein are governed by French law. In the event of a dispute, the Customer shall contact Candice Bakes to find an amicable solution. Failing this, the case will be brought before the competent courts of Epinal.
