Terms and conditions of sale - Cakes
Candice Bakes is a sole proprietorship (EI), registered with the Registre du commerce et des sociétés (R.C.S.) d'Epinal, as well as with the Chambre des métiers de l'artisanat (CMA) Grand Est under SIRET number 81391496700035 (SIREN number 813 914 967), whose head office is located at 54 Rue des Anémones 88100 SAINTE MARGUERITE. In the remainder of this document, it will be referred to by the generic term Candice Bakes.
The Candice Bakes website is accessible at the following address: www.candicebakes.com.
The workshop and cake reservation service, the physical and/or distance selling of Candice Bakes' services and products, offered by Candice Bakes, is intended exclusively for consumers for the satisfaction of their personal needs, to the exclusion of any purchase for resale.
In the remainder of this document, the consumer will be referred to as the Customer.

ARTICLE 1 - Acceptance of the general terms and conditions of sale (GTCS)
These GTC are brought to the attention of the Customer to enable him to place an order.
By confirming an order, the Customer fully accepts these GTC, which alone shall apply to the subsequent contract. By placing an order, the Customer accepts the GTS without reservation.
ARTICLE 2 - Order process
Candice Bakes offers various products such as cakes for sale, as well as various services such as pastry workshops, courses and events for individuals and professionals, the various themes of which are presented on the website. www.candicebakes.com and detailed in the personalized quotations.
The purchase or reservation of one or more products or services implies the Customer's unreserved acceptance of these terms and conditions of sale.
Offers of products and services are valid as long as they are visible on the site, while stocks last.
2a) A la carte cakes
To place an order:
- the customer chooses the cake they wish to order from the à la carte cakes and
- The Customer contacts Candice Bakes by email, telephone or via the contact form and specifies all the details for his/her order: cake selected, number of slices and pick-up times.
- Candice Bakes responds to the Customer with a payment link sent by email.
- The customer's order is confirmed after receipt of payment (unless otherwise agreed with Candice Bakes), only when Candice Bakes sends you a confirmation email with your pick-up slot (date and time). Orders are not confirmed automatically. A booking request does not constitute a booking confirmation.
- Payment by cheque or cash is possible on request, at the time of collection. The request must be confirmed by Candice Bakes.
- At the pick-up time agreed between Candice Bakes and the Customer, the Customer picks up the order. Delivery of à la carte cakes is not a service offered.
2b) Customized event cakes
To place an order:
- the customer fills in the contact form accurately and rigorously, and receives a personalized quotation as soon as possible.
- The Customer will receive a call from Candice Bakes to clarify certain points if necessary.
- In order to validate the quotation, the Customer must reply to contact@candicebakes.com by return e-mail, stating acceptance of the quotation and paying 50 % of the total price as a deposit (or the full price if the Customer so wishes) in order to validate the order. A payment link will be sent by email.
- The customer's order is confirmed after receipt of payment, only when Candice Bakes sends you a confirmation email with your pick-up slot (date and time) or delivery details. Orders are not confirmed automatically. A booking request does not constitute a booking confirmation.
- Event cakes can be delivered at an additional cost.
- On the day of collection or delivery, the Customer pays the outstanding amount.
ARTICLE 3 - Out of stock
The products and services offered on the site are subject to availability.
In case of stock shortage, Candice Bakes will contact the Customer as soon as possible to agree with him to postpone the order until the new availability of the product or service or to replace it by another product or service.
As our products are handcrafted, they are available in limited quantities. It is important to note that orders placed during the holiday season (especially the end-of-year festivities) may run a greater risk of running out of stock than orders placed at other times of the year.
ARTICLE 4 - Acceptance
The sale is not completed until full payment has been received.
Candice Bakes reserves the right to refuse an order if it is abnormal or comes from a customer with a history of payment incidents.
ARTICLE 5 - Products: presentation and composition
Product photos are for guidance only: packaging, appearance and composition may vary according to seasonality and manufacturing processes.
The Customer accepts this principle and may not make any claim in this respect.
For personalized event cakes, the decoration will be validated with the Customer. Once validated, the Customer accepts this principle and cannot make any claim in this respect.
ARTICLE 6 - Rates
Product prices are displayed in Euros, all taxes included.
ARTICLE 7 - Regulations
7a) A la carte cakes
Payment is made via a Stripe payment link that will be sent to you in your order confirmation email. Payment by cheque or cash is possible on request. The request must be confirmed by Candice Bakes.
7b) Customized event cakes
In order to validate the order, the customer pays a 50% deposit, or pays the full amount of the order if he/she so wishes. Without at least this deposit, the order will not be validated.
The customer pays the remaining 50 % upon receipt of the order.
ARTICLE 8 - Delivery :
8a) A la carte cakes
A la carte cakes ordered cannot be delivered. In view of the perishable nature of the products, the customer undertakes to collect the order at the time indicated at the time of ordering. In any case, orders cannot be kept beyond 1 day.
8b) Customized event cakes
Delivery available on request: 0.70 cts per km
ARTICLE 9 - Protection of personal data
By ordering via the www.candicebakes.comThe Customer consents to the use by Candice Bakes of nominative data concerning him/her. Pursuant to Law 78-17 of January 6, 1978, amended by Law 2018-473 of June 20, 2018, it is recalled that this data is necessary to ensure the proper processing of orders and the preparation of invoices. It may be communicated by the Vendor to service providers involved in the provision of its services. All such information is treated with the utmost rigor and discretion.
The processing of information communicated via the Website www.candicebakes.com complies with legal requirements for the protection of personal data, and the information system used ensures optimum data protection.
In accordance with current national and European regulations, the customer has a permanent right of access, modification, rectification, opposition, portability and limitation of the processing of information concerning him or her.

ARTICLE 10 - Right of withdrawal
Given the fragile and alterable nature of pastries, chocolates and similar products, the Customer may not exercise the right of withdrawal, in accordance with the provisions of article L 221-28-4° of the French Consumer Code.
The 14-day cooling-off period does not apply to contracts for the supply of perishable food products, such as goods sold by Candice Bakes.
However, insofar as possible, the Customer may modify or cancel his order, provided that the order has not already been prepared. This will be determined on a case-by-case basis. In the event of cancellation, no refund will be made.
ARTICLE 11 - Complaints
The Customer or, if applicable, the addressee named in the order form, must ensure that the order conforms to the order when it is received.

ARTICLE 12 - Product warranty
Candice Bakes guarantees the Customer that the products are manufactured and packaged according to strict quality rules, and stored in accordance with the standards in force in France.
However, Candice Bakes cannot extend its guarantee on these products if the Customer has not respected optimum storage conditions. Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.
ARTICLE 13 - Allergies
The customer undertakes to mention any allergies precisely so that none of the allergens mentioned by the customer are used in the order.
The workshops use products that may contain traces of the main allergens. Candice Basso/Candice Bakes cannot be held responsible for the ingestion of allergenic products by people who have consumed the products. It is impossible to exclude the accidental presence of other allergens which may have appeared either during the manufacture of the products by our suppliers, or during transport.
ARTICLE 14 - Intellectual property
All elements of the Site (photography, illustrations, pictograms and descriptions, logo, brand) are and remain the exclusive intellectual property of Candice Bakes.
The reproduction, representation, exploitation, redistribution or use for any purpose whatsoever, even partial, of the elements of the Site, whether software, visual or sound, are subject to the express prior authorization of Candice Bakes, holder of all intellectual property rights.
ARTICLE 15 - Applicable law
The GCS are governed by French law.
ARTICLE 16 - Disputes
All disputes arising from the purchase and sale transactions concluded in application of these general terms and conditions of sale, concerning their validity, interpretation, execution, termination, consequences and consequences, and which could not be resolved between Candice Bakes and the Customer, will be submitted to the competent courts under the conditions of common law.
The Customer is hereby informed that he may in any event have recourse to conventional mediation, in particular with the Commission de la médiation de la consommation (C. consom.art. L 612-1) or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.
